Animall Technologies Private Limited having its registered office at #51 First Floor, S.T. Bed Layout, 4th Block Koramangala, 1st Main Road, 80 Feet Rd, Bengaluru, Karnataka 560034, India, on behalf of itself and its affiliates/group companies under the brand "Animall", (hereinafter referred to as “Animall”, “Us” or “We”), is the author and publisher of the internet resource https://bhai.animall.in and the mobile application ‘Animall BHAI’ (together, “Site”). Animall owns and operates the services provided through the Site.

These User Terms and Conditions (hereinafter referred to as "Terms") govern your access to and use of the Site and the services provided by Animall (hereinafter referred to as "Services"). By accessing or using the Site and Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or Services.

1. Acceptance of Terms

By clicking the "I Agree" button or by accessing or using the Site and Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use the Site or Services.

2. Changes to Terms

Animall reserves the right, at its sole discretion, to modify or replace these Terms at any time. If the alterations constitute a material change to the Terms, Animall will notify you by posting an announcement on the Site. What constitutes a "material change" will be determined at Animall's sole discretion, in good faith, and using common sense and reasonable judgment.

You shall be responsible for reviewing and becoming familiar with any such modifications. Your continued use of the Site and Services following the posting of changes to these Terms will constitute your acceptance of those changes.

3. User Accounts

To access certain features of the Site and Services, you may be required to create an account (hereinafter referred to as "Account"). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and other login credentials and for all activities that occur under your Account. You agree to notify Animall immediately of any unauthorized use of your Account or any other breach of security. Animall will not be liable for any loss or damage arising from your failure to comply with the above requirements.

4. Service Usage

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to use the Site and Services:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• To send, knowingly receive, upload, download, use, or re-use any material which does not comply with the Content Standards set out below.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
• To impersonate or attempt to impersonate Animall, a Animall employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site and Services, or which, as determined by Animall, may harm Animall or users of the Site and Services or expose them to liability.

5. Content Standards

These content standards apply to any and all material which you contribute to the Site and Services (hereinafter referred to as "Contributions"), and to any interactive services associated with them. You must comply with the spirit and letter of the following standards in addition to the specific requirements set out in any other relevant section of these Terms.

Your Contributions must:

• Be accurate (where they state facts).
• Be genuinely held (where they state opinions).
• Comply with applicable law in India and in any country from which they are posted.

Your Contributions must not:

• Contain any material which is defamatory of any person.
• Contain any material which is obscene, offensive, hateful, or inflammatory.
• Promote discrimination, harassment, or harm against any individual or group.
• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right of any party.
• Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any legal action against Animall or you.
• Be likely to deceive any person.
• Impersonate any person, or misrepresent your identity or affiliation with any person or organization.
• Contain any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation.
• Interfere with the operation of the Site and Services or with the enjoyment of the Site and Services by other users.
• Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site and Services, the server on which the Site is stored, or any server, computer, or database connected to the Site and Services.
• Attack the Site and Services via a denial-of-service attack or a distributed denial-of-service attack.

6. Intellectual Property

The Site and Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Animall, its licensors, or other providers of such material and are protected by India and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site and Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

You must not:

• Modify copies of any materials from this site.
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
• Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this site.
• Access or use for any commercial purposes any part of the Site or Services or any services or materials available through the Site and Services.

7. Disclaimers and Limitations

Animall BHAI is a telephonic and digital guidance platform designed to provide livestock owners with general animal husbandry support, preventive care guidance, wellness information, educational assistance, and recommendations based on information shared by users. The Services are intended to assist livestock owners in making informed decisions regarding animal care; however, they are not intended to replace, substitute for, or be considered equivalent to an in-person examination, diagnosis, treatment, or professional veterinary consultation conducted by a qualified veterinarian.

Users acknowledge that the Services are provided remotely and that Animall, its representatives, consultants, advisors, and service personnel do not have the ability to physically examine, observe, test, diagnose, monitor, or independently verify the condition of any animal. Any guidance, recommendations, observations, or suggestions provided through the Services are necessarily limited by the information, photographs, videos, descriptions, records, and other materials supplied by the user.

Because the user is physically present with the animal and has direct and continuous access to observe the animal's condition, behaviour, symptoms, surroundings, and overall wellbeing, the user is often in the best position to identify signs of deterioration, distress, injury, illness, discomfort, abnormal behaviour, or circumstances requiring urgent attention. Users are expected to exercise their own judgment and act reasonably in safeguarding the health and welfare of their animals.

Animall BHAI is not an emergency response service, veterinary hospital, ambulance service, emergency helpline, critical care provider, or provider of urgent medical treatment. The Services are not designed or intended to address medical emergencies, life-threatening conditions, severe injuries, poisoning, difficult or obstructed deliveries, severe infections, sudden collapse, respiratory distress, uncontrolled bleeding, neurological emergencies, or any condition that may reasonably require immediate veterinary intervention, diagnostic testing, surgery, hospitalization, or other in-person treatment.

Users should not postpone, avoid, or delay seeking professional veterinary assistance while awaiting a response through the Services or as a result of any information received through the Services. If a user believes, suspects, or reasonably observes that an animal may be experiencing a serious illness, injury, emergency, rapidly worsening condition, or any circumstance where immediate treatment may be necessary, the user should promptly contact the nearest qualified veterinarian, veterinary hospital, animal health professional, or emergency animal care facility.

Animall reserves the right, at its sole discretion, to recommend that a user immediately seek in-person veterinary assistance and may decline to provide guidance where it determines that a remote assessment would be inappropriate, inadequate, unreliable, or potentially unsafe under the circumstances.

The accuracy, usefulness, and suitability of any information provided through the Services depend substantially upon the completeness, accuracy, and timeliness of the information supplied by the user. Users are responsible for ensuring that information shared through the Services is accurate, complete, and not misleading. Animall shall not be responsible for any consequences arising from incomplete, inaccurate, delayed, omitted, or incorrect information provided by the user.

Users acknowledge and agree that remote guidance has inherent limitations and that certain illnesses, injuries, infections, complications, and emergency conditions may not be apparent through telephonic or digital communication alone. As a result, Animall cannot guarantee that every condition can be accurately identified, assessed, diagnosed, predicted, monitored, or addressed through the Services.

By accessing or using the Services, users acknowledge and agree that:

• (a) the Services are informational and supportive in nature and are subject to the limitations of remote communication;
• (b) a physical examination, diagnostic testing, laboratory analysis, imaging, or other veterinary procedures may be necessary to properly assess an animal's condition;
• (c) Animall may recommend consultation with a local veterinarian, veterinary specialist, hospital, or emergency care provider at any time;
• (d) users remain solely responsible for determining whether and when to obtain in-person veterinary care; and
• (e) outcomes relating to the health, treatment, recovery, productivity, survival, or welfare of any animal may depend upon numerous factors beyond the control of Animall, including the timing of intervention, underlying medical conditions, husbandry practices, environmental conditions, and actions taken by the user or third parties.

To the fullest extent permitted by applicable law, Animall, its affiliates, representatives, consultants, employees, officers, directors, agents, and service providers shall not be liable for any illness, deterioration in health, injury, disability, loss, death of an animal, loss of livestock, reduction in productivity, loss of income, business interruption, consequential damages, indirect damages, special damages, or any other losses arising out of or relating to (i) reliance on information provided through the Services, (ii) the inherent limitations of remote guidance, (iii) the inability to identify or diagnose a condition remotely, or (iv) any failure or delay by the user to obtain timely in-person veterinary care.

Your use of the Site and Services is at your own risk. The Site and Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Animall, its subsidiaries, affiliates, and licensors do not warrant that:

• The Site and Services will function uninterrupted, secure, or available at any particular time or location;
• Any errors or defects will be corrected;
• The Site and Services are free of viruses or other harmful components;
• Any content or software available at or through the Site and Services is free of malware or other harmful components;
• Any data or information provided by you will be stored securely;
• Any advice or information, whether oral or written, obtained by you from Animall or through the Site and Services will create any warranty not expressly stated in these Terms.

To the maximum extent permitted by applicable law, Animall shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Site and Services, any content on the Site or Services, or any services or items obtained through the Site and Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Indemnification

You agree to defend, indemnify, and hold harmless Animall, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site and Services, including, but not limited to, your User Contributions, any use of the Site's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site and Services.

9. Termination

Animall may terminate or suspend your access to all or part of the Site and Services, without prior notice or liability, for any reason whatsoever, including, but not limited to, a breach of these Terms. Upon termination, your right to use the Site and Services will immediately cease. If you wish to terminate your Account, you may simply discontinue using the Site and Services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India, to resolve any legal matter arising from these Terms or your use of the Site and Services.

11. Miscellaneous

These Terms, together with our Privacy Policy and any other legal notices or agreements published by Animall on the Site, constitute the entire agreement between you and Animall concerning your use of the Site and Services. If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Animall to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
